These Terms of Purchase (hereinafter referred to as the “Terms of Purchase”) apply to the purchase of products and services offered through https://www.fitvorae.com (hereinafter referred to as the “Site” or “our Site”). The Site is operated by fitvorae.com (hereinafter referred to as “we” or “us”). Your use of the Site and these Terms are also subject to our Terms of Use and Privacy Notice, which are incorporated into these Terms by reference.

Please read these Terms of Purchase, the Terms of Use, the Privacy Notice, and any other policies or agreements referenced in these Terms of Purchase carefully before purchasing or using any products or services through our Site. By purchasing or using any products or services through our Site, you agree to these Terms of Purchase. This includes, but is not limited to, the arbitration agreement and class action waiver set forth in the Dispute Resolution section below.

Order Processing

We may, in our sole discretion, choose not to process or cancel your order in certain circumstances. This may occur, for example, if the product or service you wish to purchase is out of stock, if there is an error in the price display, if the order is suspected to be fraudulent, or in any other case we deem appropriate in our sole discretion. We also reserve the right, in our sole discretion, to take steps to verify your identity in order to process an order. For orders that we do not process or that we cancel, we will not charge you or will refund the amount charged. Without limiting the foregoing, we reserve the right to: (i) withdraw any offer displayed; (ii) correct any errors, inaccuracies, or omissions; and (iii) change prices, content, promotional offers, product descriptions or specifications, or other information without any obligation to notify you of such changes (including after an order has been submitted, confirmed, shipped, or received, except where prohibited by law).

Description of Products and Services

We strive to provide accurate descriptions of the products and services on our Site. However, we do not guarantee that these descriptions are accurate, complete, reliable, current, or error-free. If a product or service offered on our Site differs from its description, your sole remedy is to return the product in accordance with the procedures set forth in these Terms of Purchase.

Our Site may offer features such as a “Quick View” function for various products. This feature allows you to view product pricing information and add items to your cart without opening the product page. The Quick View feature and the “Add to Cart” function are provided solely for your convenience. You can view detailed product information, supplier details, features, and pricing on the product page.

Pricing Information

We strive to provide accurate pricing information for the products and services offered on our website. However, we cannot completely prevent pricing errors. We reserve the right, in our sole discretion, not to process or to cancel any orders placed for products or services where an incorrect price was displayed on the site due to an error. In such cases, we will notify you via email. Furthermore, we reserve the right, in our sole discretion, to correct any errors in the displayed suggested retail price.

Product and Service Availability

Our website may contain information regarding product availability. This information can be used to estimate the likelihood that a product will be shipped immediately after you place an order. The estimated delivery date to your shipping address is approximately 30 days after payment is successfully completed, but this may change due to product shortages, inclement weather, carrier transit times, or the shipping address. Unfortunately, since inventory can fluctuate significantly from day to day, we cannot guarantee that products marked as “in stock” will actually be shipped immediately. In rare cases, a product or service may be in stock when you place your order but may be sold out by the time we attempt to process your order. In such cases, we will notify you via email. Services that are out of stock will generally no longer be available. If we determine that the product or service you wish to purchase is no longer available, that item will be canceled from your order. We will notify you via email and remove the item from our website.

Specific Additional Disclaimers and Obligations

In addition to the general disclaimers in the Terms of Use regarding products and services purchased through the Site, the following may apply to products and services purchased on the Site: (a) Even if a specific product or service is offered elsewhere with a manufacturer’s warranty, the manufacturer’s warranty may not be included. (b) Service or support options may not be included. (c) Product manuals, user guides, or safety warnings may not be provided in your native language or in the language of certain destination countries. (d) Products may not be designed in accordance with the standards, specifications, and labeling requirements of your jurisdiction. (e) Products may not comply with the voltage and other electrical standards of your jurisdiction (the use of an adapter or converter may be required). You are responsible for researching the product to ensure that it meets your needs and can be legally imported into your jurisdiction, and you hereby agree to assume that responsibility.

Taxes

You are responsible for any taxes, duties, and fees imposed by the jurisdiction to which the product is shipped. This includes, but is not limited to, sales or use taxes, value-added taxes, and customs duties.
